The correspondent attorney should attend to the instructions of the instructing attorney in the same manner, skill, care, professionalism and urgency as the instructing attorney would have done. The duty of care on the instructing attorney is the same as the instructing attorney.
Who is the client?
The person or company that requires legal assistance or legal services is the client of the instructing attorney. The instructing attorney is the client of the correspondent attorney.
Who pays for the services of a correspondent attorney?
The instructing attorney is liable for the fees and disbursements of the correspondent attorney. The instructing attorney pays the correspondent attorney and in turn, collects the money from the client if the instructing attorney does not hold sufficient money in his or her trust account for the benefit of the client.
